Terms & Conditions
The general terms and conditions of JobFuel (The Social Grid B.V.) for use of the recruitment advertising platform.

These terms and conditions apply to all services of The Social Grid B.V., trading as JobFuel, established at Wijkerstraatweg 90, 1951 EJ Velsen-Noord, registered with the Dutch Chamber of Commerce under number 97863572, VAT number NL868265585B01 (hereinafter: "JobFuel").
By using the JobFuel platform, creating an account, logging in, starting a campaign, accepting a pilot, accepting a quote or order confirmation, or otherwise using JobFuel's services, the customer agrees to these terms and conditions.
1. Definitions
- JobFuel: The Social Grid B.V., provider of the recruitment advertising platform and related services.
- Customer: the company, organisation or user using JobFuel.
- User: a natural person who accesses a workspace on behalf of the customer.
- Platform: the software, dashboards, APIs and associated tooling of JobFuel.
- Workspace: the customer's isolated environment within the platform.
- Campaign: an advertising campaign created or managed via the platform.
- Candidate: a person who applies, responds, is generated or otherwise becomes known through JobFuel campaigns, forms, the platform, data or communication.
- Vacancy: an open position or role for which the customer wants to attract candidates.
- Pilot vacancy: the first free trial vacancy, excluding ad budget, only where expressly agreed.
- Filled vacancy: a vacancy for which a candidate obtained through JobFuel is hired, placed, starts work, signs a contract or otherwise becomes active for the customer or an affiliated party.
- Placement: the hiring, placement, engagement or start of work of a candidate found or introduced through JobFuel.
- Ad budget: budget paid by the customer for advertising platforms such as Meta, Google or other media platforms.
- Meta: Meta Platforms Ireland Ltd. and affiliated entities (Facebook, Instagram).
- Non-selected candidate: a candidate who responded to a specific vacancy of the customer and who was rejected, not selected or not followed up within a reasonable period by the customer.
- Recruitment partner: an established recruitment partner selected by JobFuel which JobFuel may in certain cases engage to offer a non-selected candidate, solely after that candidate's explicit consent, an additional opportunity for suitable work.
2. Applicability
These terms apply to every offer, quotation and agreement between JobFuel and the customer. Purchasing or other terms of the customer are expressly rejected. Deviations are only valid when agreed in writing.
3. About JobFuel
JobFuel offers a recruitment advertising platform with which customers can set up, manage and optimise recruitment campaigns on Meta and other supported channels, process candidates in a pipeline and use related features such as dashboards, AI assistance, integrations and reporting. JobFuel is not a recruitment agency, unless expressly agreed in a separate contract.
4. Account, workspace and user roles
A customer uses JobFuel via a workspace. Multiple users can be added within a workspace. User accounts are free by default, unless otherwise agreed.
Possible roles include:
- Workspace Admin: can invite users, assign roles and manage workspace settings.
- Marketer: manages campaigns, creatives and forms.
- Recruiter: works with candidates in the pipeline.
The customer is responsible for managing access, promptly removing former staff and correctly assigning roles. JobFuel may block or remove access in case of misuse, security risks or violation of these terms.
5. Services
JobFuel makes reasonable efforts to deliver its services carefully and provides among other things:
- access to the platform to the extent technically possible
- tooling for campaigns, forms and candidate pipeline
- forwarding of campaign and form data to Meta where configured
- retrieving and displaying candidate data based on granted permissions
- dashboards, reporting and analytics
- support according to the applicable service level
JobFuel has a best-effort obligation and not a results obligation. JobFuel gives no guarantees on a specific number of candidates, applicants or placements, on a specific cost-per-lead or cost-per-candidate, on approval of ads by Meta, Google or other platforms, on availability or suitability of candidates, or on stability of campaign performance.
6. Campaigns, Meta Instant Forms and publication
Campaigns can be set up via the standard builder or an AI-assisted builder. A campaign can remain a draft until all required information is complete. Publication may be blocked when:
- the available ad budget is insufficient
- mandatory business or billing details are missing
- the Facebook page is not connected
- the Meta Lead Ads Terms of Service have not been accepted
- required dataset or account settings have not been completed
- Meta rejects the campaign or the form
- required permissions are missing
Editing campaigns
Some campaign settings can be edited after publication. To keep performance data clean, certain live elements cannot be modified directly. For changes to creatives or forms it may be necessary to duplicate a campaign or form and publish it as a new draft. JobFuel may choose to create new versions instead of changing live assets directly.
Instant Forms
Customers can create Meta Instant Forms via JobFuel. Contact fields such as first name, last name, email address and phone number can be supplied as locked fields. The customer is responsible for the added questions and for compliance with applicable laws. JobFuel may restrict certain question types or sensitive questions to reduce legal and compliance risks. Published Meta forms are not always directly editable; changes may require a new form version. JobFuel does not guarantee that Meta accepts every form.
7. Facebook pages, candidates and Meta connections
The customer connects their own Facebook page to JobFuel. Candidate leads received via Meta Instant Forms are linked to the customer's Facebook page and Meta environment. Via the Instant Form a candidate only leaves limited contact details, such as name, phone number and email address, with the aim of being contacted by the customer about that application. JobFuel retrieves this data, displays it based on permissions granted by the customer, and processes and facilitates this candidate data within its own platform. JobFuel does not become the owner of the candidates, without prejudice to articles 7.1 through 7.3.
The customer is responsible for the recruitment process, the follow-up of candidates and the lawful use of candidate data. If the customer disconnects the Facebook page or revokes permissions, JobFuel may no longer be able to retrieve new candidate leads from that page. Previously retrieved data may be retained or deleted in accordance with the agreement, the privacy policy and legal obligations, where legally and technically possible.
7.1 No exclusivity or ownership of candidates
A candidate who responded via a campaign run by JobFuel does not remain exclusively tied to the customer after the customer has rejected or not selected that candidate. The customer does not acquire any ownership right, exclusive right or other sole right to a candidate merely because the candidate came in via a JobFuel campaign. The customer of course retains its own rights and obligations regarding the data and application process of candidates the customer takes forward itself.
7.2 Additional opportunity for non-selected candidates
JobFuel wants to avoid a candidate disappearing from view after a single unsuccessful application. JobFuel may therefore, in certain cases, offer a non-selected candidate one additional opportunity for suitable work by engaging one suitable established recruitment partner for that purpose.
- JobFuel is not obliged to do so and does not do this automatically for every non-selected candidate.
- Candidates are not made public, are not included in a public candidate database and are not made available to all customers or partners of JobFuel.
- This concerns only a limited and targeted option in which JobFuel may engage one suitable established recruitment partner.
- Before the recruitment partner obtains access to the candidate's contact details or may approach the candidate, JobFuel asks the candidate for explicit consent, for example by telephone.
- When requesting consent, JobFuel informs the candidate at least that the original application did not result in a match, which recruitment partner JobFuel wishes to engage, that this partner may have another or suitable opportunity, which personal data will be made available, and that the candidate may refuse consent.
- Only where the candidate clearly gives consent are the relevant personal data made available to that recruitment partner. JobFuel records the consent obtained, where possible including date, method of consent, the partner concerned and the purpose.
- If the candidate does not give consent, the data are not made available for this additional option.
JobFuel is not a job board and does not operate a public candidate database. The option described above is intended solely to offer candidates who turn out not to be a match for one specific application an additional chance of suitable work where possible. JobFuel observes applicable privacy legislation, including the GDPR.
7.3 No claims by the original customer
If a non-selected candidate is subsequently introduced, placed or hired elsewhere via JobFuel or a recruitment partner, the original customer can derive no rights from this and is not entitled to any fee, commission, placement fee, discount, refund, profit share or any other form of compensation. JobFuel is not obliged to introduce a rejected or non-selected candidate again. This provision does not affect the customer's obligations under article 8, including the reporting obligation and the fee per filled vacancy, where the customer hires or places the candidate itself (directly or indirectly).
Meta Lead Ads Terms
For lead campaigns to function correctly, the customer may need to accept the Meta Lead Ads Terms of Service. The customer is responsible for accepting and continuing to comply with the required Meta terms for their own Facebook page and ad accounts.
Quality feedback to Meta
JobFuel can send candidate quality feedback (for example via datasets and CRM events) back to Meta to support campaign optimisation, to the extent that the customer uses this feature and has activated the required configuration.
8. Free pilot vacancy, ad budget and fees
8.1 Free pilot vacancy
If expressly agreed with JobFuel, the cooperation may start with one free pilot vacancy. For this pilot vacancy JobFuel does not charge a fee for its services. The free pilot relates solely to JobFuel's services and not to ad budget, media budget, external costs or any third-party costs.
- The pilot vacancy is intended solely as an introduction and trial period.
- The free pilot applies only where this has been agreed in writing or is otherwise demonstrably agreed with a JobFuel representative.
- The free pilot is offered only where JobFuel decides to do so, for example where multiple vacancies are expected or where more than three vacancies are likely to be run.
- The pilot does not entitle the customer to additional free vacancies or to continued free services.
- JobFuel may refuse, suspend or end a pilot if the customer does not cooperate, fails to provide requested information or does not honour agreements made.
8.2 Ad budget is always paid by the customer
The required ad budget is always for the account of the customer. This also applies to the free pilot vacancy. Ad budget, media budget and advertising platform costs never fall under a free pilot or under JobFuel's service fees, unless agreed otherwise in writing.
This applies to the free pilot vacancy, paid vacancies, all campaigns, all media spend, spend via Meta, Google or other advertising platforms, and any additional campaign spend. Without ad budget made available in time, JobFuel cannot start or continue campaigns.
8.3 Fee per filled vacancy
After the first free pilot vacancy, the customer owes a fee for every vacancy filled through JobFuel. The amount of this fee is agreed in advance between JobFuel and the customer and may be recorded in a quote, order confirmation, email, agreement or within the JobFuel platform.
- All amounts are exclusive of VAT unless expressly stated otherwise.
- JobFuel may invoice as soon as a vacancy has been filled or a placement has been made.
- The customer must pay invoices within the payment term stated on the invoice, or within fourteen (14) days if no term is stated.
- In the event of late payment, the customer owes statutory commercial interest and extrajudicial collection costs without further notice of default, and JobFuel may suspend its services.
Where multiple candidates are hired or placed through a single vacancy, JobFuel is entitled to charge a fee per placement or per filled position, unless agreed otherwise in writing.
8.4 Definition of a filled vacancy and placement
A vacancy is considered filled where a candidate delivered, generated, introduced or made visible through JobFuel directly or indirectly enters employment, performs work, is placed, is hired or otherwise starts working for the customer or a party affiliated with the customer. This also applies where this occurs within 12 months after the candidate became known to the customer through JobFuel.
- the candidate starts work for the customer;
- the candidate signs an employment contract, contract for services or agency contract;
- the candidate accepts an offer from the customer;
- the candidate is hired, engaged or seconded directly or indirectly;
- the candidate starts via an affiliated company, sister company, subsidiary, partner, intermediary or client of the customer.
8.5 Reporting obligation
The customer is obliged to inform JobFuel immediately and in full when a candidate obtained, found, delivered or introduced through JobFuel is hired, placed or otherwise starts performing work. This reporting obligation applies regardless of whether the placement takes place directly, via a third party, via an affiliated company or at a later moment.
- The customer keeps candidate statuses up to date in the JobFuel platform.
- The customer informs JobFuel by email or via the dashboard.
- The customer may not conceal, disguise or delay reporting of placements.
- The customer may not approach, hire or place candidates outside JobFuel without reporting this.
8.6 Penalty for unreported placements
If the customer fails to report a placement or filled vacancy to JobFuel while the candidate was obtained, found, delivered or introduced through JobFuel, the customer owes JobFuel an immediately payable penalty of €10,000 per unreported filled vacancy or placement. This penalty is without prejudice to JobFuel's right to claim the agreed fee, additional damages, collection costs, statutory interest and legal costs.
JobFuel may invoice the penalty. The customer must pay this invoice within the payment term stated on the invoice. The customer may not suspend or set off payment due to a dispute, unless mandatory law provides otherwise.
8.7 Verification and audit
JobFuel may contact candidates on a sample basis and/or request the customer to provide information about candidate status, insofar as this is necessary to verify whether the customer complies with these terms, including the reporting obligation and payment obligations. JobFuel will act carefully and take applicable privacy legislation into account. The customer will provide reasonable cooperation on first request and supply reasonably requested evidence regarding candidate status.
8.8 No circumvention
The customer may not circumvent JobFuel in order to avoid fees due. This includes hiring, placing, engaging or having work performed outside JobFuel by candidates who became known through JobFuel without reporting this to JobFuel. It also includes asking candidates to apply directly, deliberately continuing the process outside the platform, using another entity to hire the candidate, or deliberately delaying a placement until after a campaign has ended.
8.9 Customer cooperation
The customer is responsible for timely and complete cooperation, including providing vacancy information, making ad budget available, following up on candidates, giving feedback and keeping candidate statuses up to date. If the customer falls short in this, JobFuel cannot be held responsible for disappointing results.
8.10 No guarantees
JobFuel makes every effort to run campaigns carefully but gives no guarantee as to the number of candidates, the quality or suitability of every candidate, the number of placements, the speed at which a vacancy is filled, the cost per candidate or approval by advertising platforms.
8.11 Responsibility for recruitment decisions
The customer is responsible for assessing, selecting, inviting, rejecting and any hiring of candidates, as well as for compliance with applicable employment, privacy and non-discrimination rules.
8.12 Continuation after the pilot
After completion of the free pilot vacancy, the customer decides whether the cooperation is continued. If the customer commissions a second or subsequent vacancy, places a candidate or otherwise continues to use the services, the agreed rates for paid vacancies apply.
8.13 Quotes, order confirmations and rate agreements
Where the parties agree a package, volume discount or specific rate arrangement, these arrangements are recorded in a quote, order confirmation or other written confirmation. In the event of conflict between the order confirmation and these terms, the order confirmation applies solely to the specific commercial arrangements, unless expressly agreed otherwise.
Where agreed, the fee per vacancy may be invoiced in instalments. The ad budget is always paid separately by the customer.
8.14 Payments and invoicing
Payments may be processed via the designated payment provider (including Mollie) or on an invoice basis. Amounts paid are non-refundable, except where legally required. Any chargebacks or payment disputes may lead to suspension of access or service. Billing and accounting data are retained in accordance with statutory periods.
9. AI features
JobFuel may offer AI-assisted features such as an AI campaign builder, suggestions for ad copy, form questions and campaign insights. AI output is a suggestion and not a finished product. The customer must review and approve AI-generated content before publication.
AI may produce incorrect, incomplete or unsuitable results. The customer remains responsible for the final campaign content, ad copy, form questions and compliance with applicable laws. Users are advised not to enter unnecessarily sensitive data into AI input fields.
10. Integrations, webhooks and external systems
The customer can connect external systems via, among others, Zapier, webhooks and supported ATS integrations. If the customer enables an integration, JobFuel can forward candidate and campaign data to the configured external system.
The customer is responsible for the receiving system, the correct configuration of webhook URLs and ATS connections, and for lawful processing in that system. JobFuel is not responsible for what happens to data after it has been delivered to an external system configured by the customer. Incorrect webhook URLs or ATS configurations are at the customer's expense.
Partner integrations
JobFuel may allow partner integrations to receive selected campaign and metric data. Such integrations are managed by admins or authorised partner users and may only be used where legally and contractually permitted.
11. Reporting and white-label features
Where available, recruitment and staffing agencies may use reporting and white-label features towards their own customers. The customer is responsible for lawfully sharing reports with third parties. White-label features do not transfer ownership of the JobFuel platform; JobFuel remains the platform provider.
12. Customer responsibilities
The customer is responsible for, among other things:
- providing correct company, billing and campaign details
- ensuring that vacancies are real and lawful
- the correctness of vacancy texts and ad content
- reviewing drafts, AI-generated content, forms, questions, images and ad copy before publication
- compliance with applicable labour, recruitment, anti-discrimination and privacy laws
- having a lawful basis to approach and follow up on candidates
- making available and paying for the required ad budget
- reporting every placement or filled vacancy to JobFuel in full and without delay
- keeping candidate statuses up to date in the platform
- accepting and maintaining the Meta Lead Ads Terms of Service where required
- management of their own Facebook page and connected accounts
- having permission to connect Facebook pages and assets to JobFuel
- the correct configuration of external integrations such as Zapier and webhooks
13. JobFuel responsibilities
JobFuel is responsible for, among other things:
- making the platform available to the extent technically possible
- processing data in accordance with the agreed arrangements and the privacy policy
- taking reasonable security measures
- providing campaign tooling and dashboard functionality
- forwarding campaign and form data to Meta where configured
- retrieving leads where the required permissions and connections are in place
- displaying campaign and candidate data to the extent available
- support according to the applicable service level
14. Third parties and platform dependencies
JobFuel uses and depends on third-party services, including Meta (Facebook, Instagram, Facebook Pages, Meta Instant Forms, Meta Marketing API, Meta Events Manager/datasets), Google (where used), YouTube embeds, Google Analytics, Zapier and webhook receivers, payment providers, email providers, hosting providers and AI providers.
JobFuel is not responsible for, among other things:
- outages or downtime at external platforms
- changes in third-party APIs or policies
- rejection of ads by Meta, Google or other platforms
- delays in data delivery by external platforms
- disconnection of Facebook pages or revocation of permissions
- incorrect configuration by the customer
- limits, rules or decisions of Meta, Google or other platforms
In the event of large-scale outages or temporary campaign publication issues, JobFuel may inform customers via dashboard notifications or email.
15. Availability, maintenance and outages
JobFuel strives for high platform availability but does not guarantee uninterrupted availability. JobFuel may carry out maintenance and temporarily take the platform fully or partially out of use. Where possible, planned maintenance is announced in advance.
16. Intellectual property
JobFuel owns or holds a licence to the platform, software, dashboards, workflows, designs, templates, AI prompts, logic and documentation. The customer receives a limited, non-exclusive and non-transferable right of use for the duration of the agreement. It is not permitted to copy, reverse engineer, resell or misuse the platform.
Materials supplied by the customer, such as logos, vacancy texts, brand assets and uploaded creatives, remain the property of the customer. The customer grants JobFuel a non-exclusive right to use these materials to the extent necessary to deliver the service.
17. Acceptable use
It is not permitted to use the platform for, among other things:
- unlawful or illegal use
- discriminatory recruitment practices
- misleading or false vacancies
- spam or unsolicited commercial communication
- uploading malware or harmful code
- attempts to access data of other customers
- reverse engineering or bypassing security measures
- misuse of Meta, Google or other integrations
- uploading unlawful content
- collecting special/sensitive candidate data without a valid legal basis
- using the platform for purposes other than recruitment without consent
18. Privacy and data processing
JobFuel processes personal data in accordance with the GDPR and the privacy policy. For cookies the cookie statement applies.
With respect to candidate data processed for a specific vacancy of the customer and the customer's own selection process, JobFuel processes that data on behalf of and in accordance with the instructions of the customer. For that processing the customer is the controller and JobFuel acts as processor. The processor arrangements are included in the privacy policy and these terms and apply automatically when using the platform. A separate data processing agreement can be concluded on request.
For the additional processing described in article 7.2, which only takes place after a candidate has been rejected or not selected by the customer and for which the candidate is separately asked for explicit consent, JobFuel does not act on the instructions of the customer but for its own purpose as described in article 7.2. For that processing JobFuel determines the purposes and means itself and bears the corresponding responsibility under applicable privacy legislation. The definitive data protection qualification of the parties is assessed on the basis of the actual circumstances and applicable law. The parties will provide each other with reasonable cooperation where necessary to comply with their GDPR obligations.
19. Suspension and termination
JobFuel may suspend or terminate access or services when, among other things:
- invoices or payments remain unpaid
- the ad budget made available by the customer is insufficient to continue campaigns
- the customer breaches these terms
- the customer fails to comply with the reporting obligation or circumvents JobFuel
- the customer misuses the platform
- required connections with third parties are broken
- security risks arise
- Meta, Google or another party blocks required access
The customer may terminate use in accordance with the agreement. After termination, access to the platform and data may be limited or deleted, in accordance with the privacy policy, retention periods and legal obligations.
20. Liability
JobFuel is not liable for indirect damage, consequential damage, lost profit, missed revenue, missed candidates or placements, reputational damage, or damage caused by outages or delays at external platforms, except to the extent liability cannot be excluded by law.
JobFuel's total liability arising out of or in connection with the agreement is in all cases limited to the amount paid by the customer to JobFuel in the three (3) months preceding the event causing the damage (excluding ad spend), unless mandatory law provides otherwise.
JobFuel's liability only arises when the customer notifies JobFuel promptly and properly in writing of the default, with a reasonable period to still perform, and JobFuel remains attributably in breach after that period.
21. Force majeure
JobFuel is not liable for shortcomings resulting from force majeure. Force majeure includes: outages or downtime of internet, hosting, telecommunications or external platforms (including Meta and Google), changes in third-party APIs or policies, cyberattacks, government measures, strikes and other circumstances beyond JobFuel's reasonable control.
22. Amendments to the terms
JobFuel may amend these terms. Material changes are, where required, announced via the dashboard or by email. Continued use of the platform after the changes take effect is deemed acceptance of the new terms, to the extent legally permitted.
23. Governing law and disputes
These terms and all agreements with JobFuel are exclusively governed by Dutch law. Disputes are submitted exclusively to the competent court of the District Court of North Holland, unless mandatory law designates another court.
